1. Parties and Scope

These Terms of Use (the "Terms") govern the relationship between Kolaytik Teknoloji ("Kolaytik", "we") and any natural or legal person ("User", "you") who accesses or uses the website, mobile applications, and related digital services (the "Service") provided by Kolaytik. By accessing or using the Service, you acknowledge that you have read, understood, and agree to these Terms.

If you do not accept these Terms, you must not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

2. Description of the Service

Kolaytik provides a cloud-based software service for creating, managing, and reporting on digital forms, documents, and business processes. The scope, features, and available plans of the Service may be updated from time to time. Certain features may vary depending on the subscription plan you select.

3. User Obligations

When using the Service, you agree to comply with the following obligations:

• Provide accurate, current, and complete account information and keep it confidential.
• Be responsible for all activity carried out through your account.
• Not upload or share content that violates applicable law, the rights of third parties, or public morality.
• Not attempt to compromise the security or operation of the Service.
• Use the Service only for lawful purposes and in accordance with these Terms.

4. Intellectual Property

All intellectual and industrial property rights in the software, designs, trademarks, logos, text, and other content relating to the Service belong to Kolaytik or its licensors. These Terms grant you a limited, non-exclusive, and non-transferable right to use the Service; they do not constitute a transfer of any ownership rights. Content and data you create through the Service belong to you and are processed only to the extent necessary to provide the Service.

5. Service Continuity and Changes

Kolaytik uses reasonable efforts to provide the Service without interruption or error; however, temporary interruptions may occur due to maintenance, updates, technical failures, or reasons arising from third-party service providers. Kolaytik reserves the right to modify the scope, features, or these Terms of the Service upon reasonable prior notice. Continuing to use the Service after changes take effect means you accept the updated Terms.

6. Limitation of Liability

To the maximum extent permitted by applicable law, the Service is provided "as is". To the extent permitted by applicable law, Kolaytik shall not be liable for indirect, incidental, or consequential damages, or for loss of data or loss of profit. This section does not exclude liabilities that cannot be limited under applicable law.

7. Termination

If you breach these Terms, Kolaytik may suspend your account or terminate your access to the Service. You may terminate your subscription at any time in accordance with the terms of your plan. Upon termination, provisions that by their nature should remain in effect will continue to apply.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. The Courts and Execution Offices of Antalya shall have jurisdiction over any disputes arising from the application of these Terms.
